Before you Sue

Make sure you sue the right company or person! Be careful when you are suing someone for something that they have done as part of a business dealing. If you sue the person individually, you might not be able to collect on the judgement from their company.

One of the biggest problems you can have in collecting your judgement is if you sue the wrong entity. Always check on the real name of a business. Check on the names of the owners of the business. Sometimes a particular location might be a franchise, in which case suing the company that granted the franchise might not be of any use.

Check with the local clerk of courts about who is the real owner, and real name, for the business. You might need to check with a business licensing department.

Finally, try to identify all possible parties with any involvement and responsibility for the situation. For example, a computer repairman burns out your computer when trying to install a new power supply. You might sue the repairman, the shop he works for, the corporate owner or parent of the shop. You can sue all of them at the same time.
